Dear Ms. Sadowsky:
This is in reference to the request filed on June 6, 2013. BRE requests an extension of
the STA originally granted on December 13, 2012, to operate with temporary facilities.' In
support of the request, BRE states that it did not complete construction of the authorized STA
facilities (and has remained operating with currently licensed facilities from the licensed site)
because the licensed site was not sold as previously anticipated.
Requests for extension of STA will be granted only where the licensee can show that one
or more of the following criteria have been met:
Restoration of licensed facilities is complete and testing is underway;
Substantial progress has been made during the most recent STA period toward
restoration of licensed operation; or
No progress has been made during the most recent STA period for reasons clearly
beyond the licensee's control, and the licensee has taken all possible steps to
expeditiously resolve the problem.
Accordingly, the request for STA extension IS HEREBY GRANTED, and station KXEN
may commence operation with the following temporary facilities:

KXEN is licensed for directional operation on 1010 kHz with 50 kW day and 0.5 kW night.

It will be necessary to further reduce power or cease operation if complaints of
interference are received. BRE must use whatever means are necessary to protect workers and
the public from exposure to radio frequency radiation in excess of the Commission's exposure
guidelines. See 47 CFR § 1.13 10.
This authority expires on January 10, 2014. It should be noted that failure to file an
FCC Form 301 application for a new site facility and/or provide a justification indicating a
specific contract date that BRE will be required to vacate the licensed site will result in denial of
an\' future request for extension and cancellation of the original STA (and BRE will be directed
to file a new STA request after the actual loss of site date is known).
